Projekt "Právne služby na podporu implementácie SO SAŽP v rámci OP KŽP" je zameraný na financovanie zabezpečenia právnych služieb na základe požiadaviek Slovenskej agentúry životného prostredia (SAŽP) ako sprostredkovateľského orgánu pre Operačný program Životné prostredie a Operačný program Kvalita životného prostredia na základe uzatvorenej Zmluvy o poskytnutí právnych služieb č. SAŽP SFEÚ/2018/16 s dodávateľom SOUKENÍK - ŠTRPKA, s.r.o. (http://www.crz.gov.sk/index.php?ID=3317208&l=sk) v období od februára 2018 do februára 2019 v nasledovných oblastiach: a) zastupovanie SAŽP pred súdmi a orgánmi verejnej moci;b) zastupovanie v konaniach pred príslušným súdom SR vo veciach preskúmania zákonnosti rozhodnutí a postupov SAŽP a/alebo na základe žalôb alebo opravných prostriedkov podľa Správneho súdneho poriadku, vrátane konaní o opravných prostriedkoch;c) zastupovanie v konaniach pred príslušným súdom SR vo veciach o náhradu škody, nahradenie vôle, alebo poskytnutie plnenia majúce právny základ v zmluve o poskytnutí nenávratného finančného príspevku, v konaní SO o ukončení zmluvy o poskytnutí nenávratného finančného príspevku, vrátane konaní o opravných prostriedkoch;d) zastupovanie a právna podpora v konaniach pred príslušným súdom SR v súvislosti s/alebo vyvolaných zákonom č. 7/2005 Z. z. o konkurze a reštrukturalizácii a o zmene niektorých zákonov v platnom znení v súvislosti s uplatnením práv Riadiaceho orgánu;e) právne služby a zastupovanie vo veciach trestných, správnych, obchodných, pracovno-právnycha občianskych v súvislosti s vykonávaním programov EÚ a/alebo v súvislosti s poskytnutím spolufinancovania projektov zo štátneho rozpočtu SR;f) prevzatia zastúpenia za klienta voči iným štátnym orgánom, fyzickým osobám alebo právnickým osobámv prípade vzniku sporu vyplývajúceho z implementácie projektov financovaných z fondov EÚ a/alebo ŠR;g) vypracovanie právnych analýz, stanovísk, odporúčaní, rozborov ohľadne rôznych postupov SAŽP, pripomienok v právnych veciach vrátane posúdenia príslušných dokumentov, ktoré vyplývajú z riešenia sporných vecí;h) vypracovanie stanovísk a právnych rozborov ohľadne sporných otázok pri nakladaní s hnuteľným a nehnuteľným majetkom v rámci implementácie projektov financovaných z fondov EÚ a/alebo zo štátneho rozpočtu SR;i) právne analýzy a ostatné právne služby v súvislosti s legislatívou SR a EÚ;j) právne služby v oblasti aplikácie zákona o verejnom obstarávaní č. 343/2015 Z. z. v znení neskorších predpisov a smerníc EÚ v oblasti verejného obstarávania, aplikácie zákona č. 25/2006 Z. z. o verejnom obstarávaní o zmene a doplnení niektorých zákonov, vrátane konzultácií priamo u klienta, účasti na rokovaniach s tretími stranami a právnych služieb vo veciach kontroly alebo dohľadu vykonávaných orgánmi verejnej moci v oblasti verejného obstarávania;k) príprava návrhov legislatívnych zmien podľa požiadaviek SAŽP, účasť na rokovaniach a pracovných stretnutiach týkajúcich sa týchto návrhov a poskytovanie s tým súvisiaceho právneho poradenstva klientovi,l) vypracovanie odborných stanovísk k právnym problémom súvisiacim s procesmi a postupmi vo verejnom obstarávaní v zmysle platných všeobecne záväzných právnych predpisov upravujúcich verejné obstarávanie;m) vypracovanie právnych analýz, stanovísk, odporúčaní, rozborov na posúdenie jestvujúcich obchodných zmlúv SAŽP. Dĺžka realizácie projektu je 13 mesiacov. Miesto realizácie projektu je územie SR. V rámci projektu aktivita spadá do špecifického cieľa:5.1.1 Zabezpečenie efektívnej implementácie programu (oblasť intervencie 121). Výsledkom projektu bude posilnenie kvality vyššie uvedených činností a bude tak zabezpečený pozitívny dopad na implementáciu OP KŽP so snahou minimalizovať problémové oblasti, s ktorými sa SO stretáva v rámci implementácie OP KŽP. Slovenská agentúra životného prostredia ako príspevková organizácia MŽP SR je finančnými vzťahmi napojená na rozpočet MŽP SR. Okrem týchto zdrojov získava nenávratné finančné prostriedky z grantov a projektov, ktoré sú poskytované z fondov EÚ alebo zo štátneho rozpočtu. Uvedené príjmy nie sú príjmami dosiahnutými ekonomickou činnosťou a preto v tejto činnosti nemožno hovoriť o SAŽP ako o zdaniteľnej osobe. Z uvedeného vyplýva, že príjmy nepodliehajú daňovej povinnosti DPH a pri vzniknutých nákladoch nie je možné uplatňovať odpočet DPH. Za týchto okolností SAŽP nie je platcom DPH. V zmysle uvedeného si SAŽP nebude nárokovať odpočet DPH v rámci vzniknutých výdavkov projektu "Právne služby na podporu implementácie SO SAŽP v rámci OP KŽP".SAŽP však hospodári aj s vlastnými prostriedkami získanými ekonomickou činnosťou v súlade s výpisom zo živnostenského registra č. 601-10745. Tieto prostriedky prednostne využíva na skvalitňovanie služieb poskytovaných v oblasti hlavnej činnosti. Príjmy dosahované v tejto činnosti sú zdaniteľnými príjmami v súlade s ustanovením §2 Zákona o DPH - podliehajú daňovej povinnosti. The project “Legal services to support the implementation of IB SAŽP in the framework of the OP KŽP” is aimed at financing the provision of legal services on the basis of the requirements of the Slovak Environmental Agency (SAŽP) as an intermediary body for the Operational Programme Environment and Operational Programme Quality of the Environment on the basis of the concluded Contract for the Provision of Legal Services No SAŽP SFEU/2018/16 with the contractor Soukeník – ŠTRPKA, s.r.o. (http://www.crz.gov.sk/index.php?ID=3317208&l=sk) in the following areas: a) representation of SAŽP before courts and public authorities;b) representation in proceedings before the competent court of the Slovak Republic in matters of review of the legality of decisions and procedures of SAŽP and/or on the basis of actions or remedies under the Administrative Judicial Code, including appeal procedures;c) representation in proceedings before the competent court of the Slovak Republic in matters of damages, compensation of wills, or provision of performance having a legal basis in the contract for the provision of non-repayable financial contribution, in proceedings of the IB on the termination of the contract on the provision of non-repayable financial contribution, including proceedings on remedies;d) representation and legal support in proceedings before the competent court of the Slovak Republic in connection with/or triggered by Act No 7/2005 Coll. on bankruptcy and restructuring and amending certain acts as amended in relation to the exercise of the rights of the Management Authority;e) legal services and representation in matters of criminal, administrative, commercial, civil labour law in connection with the implementation of EU programmes and/or in connection with the provision of co-financing of projects from the state budget of the Slovak Republic;f) taking over the representation of the client vis-à-vis other state bodies, natural persons or legal persons in the event of a dispute arising from the implementation of projects financed by EU funds and/or the ŠR;g) elaboration of legal analyses, opinions, recommendations, analyses of the various procedures of SAŽP, comments in legal matters, including the assessment of relevant documents, (h) drafting of opinions and legal analyses on disputed issues in the management of movable and immovable property in the framework of the implementation of projects financed by EU funds and/or from the state budget of the Slovak Republic;(i) legal analyses and other legal services in connection with Slovak and EU legislation;(j) legal services in the field of application of the Public Procurement Act No 343/2015, as amended and EU directives in the field of public procurement, application of Act No. 25/2006 Coll. on Public Procurement on Amendments and Supplements to Certain Acts, including consultations directly with the client, participation in negotiations with third parties and legal services in matters of control or supervision carried out by public authorities in the field of public procurement;k) preparation of draft legislative amendments according to the requirements of SAŽP, participation in negotiations and working meetings on these proposals and provision of related legal advice to the client,l) elaboration of expert opinions on legal issues related to public procurement processes and procedures within the meaning of applicable generally binding legal regulations governing public procurement;m) elaboration of legal analyses, opinions, recommendations, analyses for the assessment of existing business contracts SAŽP. The duration of the project is 13 months. The place of implementation of the project is the territory of the Slovak Republic. Under the project, the activity falls under a specific cieľa:5.1.1 Ensuring effective implementation of the programme (intervention area 121). The result of the project will be to strengthen the quality of the above activities and thus ensure a positive impact on the implementation of the OP ABP with the aim of minimising the problem areas encountered by the IB in the framework of the implementation of the OP ABP. The Slovak Environment Agency, as a contributory organisation of the Ministry of the Environment of the Slovak Republic, is linked to the budget of the Ministry of the Environment. In addition to these resources, it receives non-repayable funding from grants and projects provided by EU funds or from the national budget. That income is not income generated by an economic activity and therefore, in that activity, SAŽP cannot be referred to as a taxable person. It follows from the foregoing that the revenue is not subject to VAT and that it is not possible to deduct VAT on the costs incurred. In those circumstances, SAŽP is not a taxable person for VAT. Le projet «Services juridiques pour soutenir la mise en œuvre d’IB SAŽP dans le cadre du PO KŽP» vise à financer la fourniture de services juridiques sur la base des exigences de l’Agence slovaque pour l’environnement (SAŽP) en tant qu’organisme intermédiaire pour le programme opérationnel «Environnement» et le programme opérationnel «Qualité de l’environnement», sur la base du contrat conclu pour la fourniture de services juridiques no SAŽP SFEU/2018/16 avec le contractant Soukeník — ŠTRPKA, s.r.o. Le résultat du projet sera de renforcer la qualité des activités susmentionnées et d’assurer ainsi un impact positif sur la mise en œuvre du PO SPA dans le but de réduire au minimum les problèmes rencontrés par l’IB dans le cadre de la mise en œuvre du PO SPA. Das Projekt „Rechtliche Dienstleistungen zur Unterstützung der Umsetzung der IB SAŽP im Rahmen des OP KŽP“ zielt auf die Finanzierung der Erbringung juristischer Dienstleistungen auf der Grundlage der Anforderungen der Slowakischen Umweltagentur (SAŽP) als Vermittlungsstelle für das operationelle Programm Umwelt und operationelles Programm Qualität der Umwelt auf der Grundlage des abgeschlossenen Vertrags über die Erbringung von Rechtsdienstleistungen Nr. SAŽP SFEU/2018/16 mit dem Auftragnehmer Soukeník – ŠTRPKA, s.r.o. (http://www.crz.gov.sk/index.php?ID=3317208&l=sk) in den folgenden Bereichen ab: a) Vertretung von SAŽP vor Gerichten und Behörden; b) Vertretung in Verfahren vor dem zuständigen Gericht der Slowakischen Republik im Bereich der Kontrolle der Rechtmäßigkeit von Entscheidungen und Verfahren von SAŽP und/oder auf der Grundlage von Klagen oder Rechtsbehelfen nach dem Verwaltungsgerichtsgesetzbuch, einschließlich Rechtsmittelverfahren; c) Vertretung in Verfahren vor dem zuständigen Gericht der Slowakischen Republik in Sachen Schadensersatz, Entschädigung von Testamenten oder Erfüllung, die eine Rechtsgrundlage im Vertrag über die Bereitstellung einer nicht rückzahlbaren finanziellen Gegenleistung hat, in Verfahren der ZB über die Beendigung des Vertrags über die Bereitstellung nicht rückzahlbarer finanzieller Beiträge, einschließlich Rechtsbehelfsverfahren, d) Vertretung und rechtliche Unterstützung in Verfahren vor dem zuständigen Gericht der Slowakischen Republik im Zusammenhang mit/oder ausgelöst durch das Gesetz Nr. 7/2005 Slg. über Insolvenz und Umstrukturierung und Änderung bestimmter Rechtsakte in der geänderten Fassung in Bezug auf die Ausübung der Rechte der Verwaltungsbehörde;e) Rechtsdienste und Vertretung in Strafsachen, Verwaltungs-, Handels-, Zivil- und Arbeitsrecht im Zusammenhang mit der Durchführung von EU-Programmen und/oder im Zusammenhang mit der Kofinanzierung von Projekten aus dem Staatshaushalt der Slowakischen Republik;f) Übernahme der Vertretung des Auftraggebers gegenüber anderen staatlichen Stellen, natürlichen Personen oder juristischen Personen im Falle einer Streitigkeit, die sich aus der Durchführung von aus EU-Mitteln finanzierten Projekten und/oder dem ŠR ergibt;g) Ausarbeitung rechtlicher Analysen, Stellungnahmen, Empfehlungen, Analysen der verschiedenen Verfahren von SAŽP, Stellungnahmen in Rechtsfragen, einschließlich der Bewertung einschlägiger Dokumente, h) Erarbeitung von Stellungnahmen und Rechtsanalysen zu strittigen Fragen der Verwaltung beweglicher und unbeweglicher Sachen im Rahmen der Durchführung von Projekten, die aus EU-Mitteln und/oder aus dem Staatshaushalt der Slowakischen Republik finanziert werden; i) rechtliche Analysen und sonstige juristische Dienstleistungen im Zusammenhang mit slowakischen und EU-Rechtsvorschriften; j) juristische Dienstleistungen auf dem Gebiet der Anwendung des Gesetzes Nr. 343/2015 über das öffentliche Auftragswesen, in der geänderten Fassung und den EU-Richtlinien im Bereich des öffentlichen Auftragswesens, Anwendung des Gesetzes Nr. 25/2006 Slg. über das öffentliche Beschaffungswesen über Änderungen und Ergänzungen bestimmter Rechtsakte, einschließlich Konsultationen direkt mit dem Auftraggeber, Teilnahme an Verhandlungen mit Dritten und juristischen Dienstleistungen in Fragen der Kontrolle oder Überwachung durch öffentliche Stellen im Bereich des öffentlichen Auftragswesens;k) Ausarbeitung von Entwürfen für Gesetzesänderungen gemäß den Anforderungen von SAŽP, Teilnahme an Verhandlungen und Arbeitssitzungen zu diesen Vorschlägen und Bereitstellung entsprechender Rechtsberatung für den Auftraggeber, L) Erarbeitung von Gutachten zu rechtlichen Fragen im Zusammenhang mit Verfahren und Verfahren des öffentlichen Auftragswesens im Sinne der geltenden allgemein verbindlichen Rechtsvorschriften für das öffentliche Auftragswesen; m) Ausarbeitung von Rechtsanalysen, Stellungnahmen, Empfehlungen, Analysen zur Bewertung bestehender Geschäftsverträge SAŽP. Die Projektlaufzeit beträgt 13 Monate. Ort der Durchführung des Projekts ist das Gebiet der Slowakischen Republik. Im Rahmen des Projekts fällt die Maßnahme unter eine spezifische cieľa:5.1.1 - Gewährleistung einer wirksamen Durchführung des Programms (Interventionsbereich 121). Das Ergebnis des Projekts wird darin bestehen, die Qualität der oben genannten Tätigkeiten zu verbessern und so eine positive Wirkung auf die Umsetzung des OP ABP zu gewährleisten, um die Problembereiche, auf die sich die IB im Rahmen der Umsetzung des OP ABP stellt, auf ein Minimum zu beschränken. Die slowakische Umweltagentur ist als mitwirkende Organisation des Umweltministeriums der Slowakischen Republik mit dem Haushalt des Umweltministeriums verbunden. Het project „Juridische diensten ter ondersteuning van de uitvoering van IB SAŽP in het kader van het OP KŽP” is gericht op de financiering van de verlening van juridische diensten op basis van de eisen van het Slowaakse Milieuagentschap (SAŽP) als intermediair orgaan voor het operationele programma Milieu en operationele programmakwaliteit van het milieu op basis van het contract voor de verlening van juridische diensten nr. SAŽP SFEU/2018/16 met de contractant Soukeník — ŠTRPKA, s.r.o. (http://www.crz.gov.sk/index.php?ID=3317208&l=sk) op de volgende gebieden: a) vertegenwoordiging van SAŽP voor rechtbanken en overheidsinstanties;b) vertegenwoordiging in procedures voor de bevoegde rechter van de Slowaakse Republiek bij de toetsing van de wettigheid van besluiten en procedures van SAŽP en/of op basis van vorderingen of rechtsmiddelen op grond van het wetboek van bestuursrechtbank, met inbegrip van beroepsprocedures;c) vertegenwoordiging in procedures voor de bevoegde rechter van de Slowaakse Republiek op het gebied van schadevergoeding, schadeloosstelling van testamenten of verstrekking van testamenten met een rechtsgrondslag in de overeenkomst voor het verstrekken van niet-terugvorderbare financiële bijdrage; in procedures van de IB over de beëindiging van de overeenkomst inzake het verstrekken van niet-terugvorderbare financiële bijdrage, met inbegrip van procedures inzake rechtsmiddelen;d) vertegenwoordiging en rechtsbijstand in procedures voor de bevoegde rechtbank van de Slowaakse Republiek in verband met/of ingeleid door Wet nr. 7/2005 Coll. inzake faillissement en herstructurering en tot wijziging van bepaalde handelingen zoals gewijzigd in verband met de uitoefening van de rechten van de beheersautoriteit;e) juridische diensten en vertegenwoordiging in strafzaken; bestuurs-, handels- en burgerlijk arbeidsrecht in verband met de uitvoering van EU-programma’s en/of in verband met de medefinanciering van projecten uit de overheidsbegroting van de Slowaakse Republiek;f) overname van de vertegenwoordiging van de cliënt ten opzichte van andere overheidsinstanties, natuurlijke personen of rechtspersonen in geval van een geschil dat voortvloeit uit de uitvoering van projecten gefinancierd uit EU-middelen en/of het ŠR;g) het opstellen van juridische analyses; adviezen, aanbevelingen, analyses van de verschillende procedures van SAŽP, opmerkingen op juridisch gebied, met inbegrip van de beoordeling van relevante documenten, h) het opstellen van adviezen en juridische analyses over betwiste kwesties in verband met het beheer van roerende en onroerende goederen in het kader van de uitvoering van projecten die worden gefinancierd uit EU-middelen en/of uit de overheidsbegroting van de Slowaakse Republiek;i) juridische analyses en andere juridische diensten in verband met de Slowaakse en EU-wetgeving;j) juridische diensten op het gebied van de toepassing van Wet nr. 343/2015 inzake overheidsopdrachten, zoals gewijzigd en EU-richtlijnen op het gebied van overheidsopdrachten, toepassing van Wet nr. 25/2006 Coll. inzake overheidsopdrachten inzake wijzigingen en aanvullingen op bepaalde wetten, met inbegrip van rechtstreeks overleg met de cliënt, deelname aan onderhandelingen met derden en juridische diensten op het gebied van controle of toezicht door overheidsinstanties op het gebied van overheidsopdrachten;k) voorbereiding van ontwerpwetgevingswijzigingen overeenkomstig de vereisten van SAŽP, deelname aan onderhandelingen en werkvergaderingen over deze voorstellen en verstrekking van daarmee verband houdende juridisch advies aan de cliënt, l) het opstellen van adviezen van deskundigen over juridische kwesties in verband met aanbestedingsprocedures en -procedures in de zin van toepasselijke algemeen bindende wettelijke voorschriften inzake overheidsopdrachten;m) uitwerking van juridische analyses, adviezen, aanbevelingen, analyses voor de beoordeling van bestaande bedrijfscontracten SAŽP. De duur van het project bedraagt 13 maanden. De plaats van uitvoering van het project is het grondgebied van de Slowaakse Republiek. In het kader van het project valt de activiteit onder een specifiek cieľa:5.1.1 Zorgen voor een doeltreffende uitvoering van het programma (interventiegebied 121). Het resultaat van het project is de kwaliteit van de bovengenoemde activiteiten te verbeteren en zo een positief effect op de uitvoering van het OP DBP te waarborgen, teneinde de probleemgebieden waarmee de IB in het kader van de uitvoering van het OP DBP wordt geconfronteerd, tot een minimum te beperken. La durata del progetto è di 13 mesi. Il luogo di attuazione del progetto è il territorio della Repubblica slovacca. Nell'ambito del progetto, l'attività rientra in uno specifico cieľa:5.1.1 Garantire l'effettiva attuazione del programma (area di intervento 121). Il risultato del progetto sarà quello di rafforzare la qualità delle attività di cui sopra e quindi di garantire un impatto positivo sull'attuazione del PO ABP con l'obiettivo di ridurre al minimo le aree problematiche incontrate dall'OI nel quadro dell'attuazione del PO ABP. L'Agenzia slovacca per l'ambiente, in quanto organizzazione contributiva del ministero dell'Ambiente della Repubblica slovacca, è collegata al bilancio del ministero dell'Ambiente. Oltre a queste risorse, riceve finanziamenti non rimborsabili da sovvenzioni e progetti erogati dai fondi dell'UE o dal bilancio nazionale. Tali redditi non sono redditi generati da un'attività economica e pertanto, in tale attività, la SAŽP non può essere indicata come soggetto passivo. Da quanto precede risulta che le entrate non sono soggette all'IVA e che non è possibile detrarre l'IVA sulle spese sostenute. Ciò premesso, la SAŽP non è un soggetto passivo dell'IVA. En el marco del proyecto, la actividad se inscribe en un ámbito específico: garantizar la ejecución efectiva del programa (ámbito de intervención 121). El resultado del proyecto será reforzar la calidad de las actividades mencionadas y garantizar así un impacto positivo en la aplicación del PO SPA con el objetivo de minimizar los ámbitos problemáticos encontrados por el OI en el marco de la aplicación del PO SPA. La Agencia Eslovaca de Medio Ambiente, como organización contributiva del Ministerio de Medio Ambiente de la República Eslovaca, está vinculada al presupuesto del Ministerio de Medio Ambiente. Además de estos recursos, recibe financiación no reembolsable de subvenciones y proyectos proporcionados por fondos de la UE o del presupuesto nacional. Estos rendimientos no son ingresos generados por una actividad económica y, por lo tanto, en dicha actividad, SAŽP no puede denominarse sujeto pasivo. De lo anterior se desprende que los ingresos no están sujetos al IVA y que no es posible deducir el IVA sobre los gastos soportados. En estas circunstancias, SAŽP no es sujeto pasivo del IVA. Projekti raames kuulub tegevus spetsiaalsesse e-posti aadressile cieľa:5.1.1 Programmi tõhusa rakendamise tagamine (sekkumisvaldkond 121). Projekti tulemuseks on eespool nimetatud tegevuste kvaliteedi parandamine ja seega positiivse mõju tagamine loomsete kõrvalsaaduste rakenduskava rakendamisele, et minimeerida probleeme, millega vahendusasutus loomsete kõrvalsaaduste rakenduskava rakendamise raames kokku puutus. Slovaki Keskkonnaamet kui Slovaki Vabariigi Keskkonnaministeeriumi toetav organisatsioon on seotud keskkonnaministeeriumi eelarvega. Lisaks nendele vahenditele saab ta tagastamatut toetust ELi fondidest või riigieelarvest antavatest toetustest ja projektidest. See tulu ei ole majandustegevusest saadud tulu ja seega ei saa SAŽP–i selles tegevuses maksukohustuslasena nimetada. Projekto rezultatas – pagerinti pirmiau minėtos veiklos kokybę ir taip užtikrinti teigiamą poveikį VP ŠGP įgyvendinimui, siekiant kuo labiau sumažinti problemines sritis, su kuriomis susiduria TI įgyvendinant VP ŠGP. Slovakijos aplinkos agentūra, kaip Slovakijos Respublikos aplinkos ministerijos prisidedanti organizacija, yra susijusi su Aplinkos ministerijos biudžetu. Be šių išteklių, ji gauna negrąžintiną finansavimą iš dotacijų ir projektų, suteiktų iš ES lėšų, arba iš nacionalinio biudžeto. Šios pajamos nėra pajamos, gautos vykdant ekonominę veiklą, todėl SAŽP negali būti laikoma apmokestinamuoju asmeniu. U okviru projekta aktivnost je obuhvaćena posebnom cieľa:5.1.1 Osiguravanjem učinkovite provedbe programa (područje intervencije 121). Rezultat projekta bit će jačanje kvalitete navedenih aktivnosti i time osiguravanje pozitivnog učinka na provedbu OP-a ABP s ciljem smanjenja problematičnih područja s kojima se posredničko tijelo susrelo u okviru provedbe NŽP-a OP-a. Slovačka agencija za okoliš, kao organizacija doprinositelja Ministarstva okoliša Slovačke Republike, povezana je s proračunom Ministarstva okoliša. Osim tih sredstava, prima bespovratna sredstva iz bespovratnih sredstava i projekata iz fondova EU-a ili iz nacionalnog proračuna. Ti prihodi nisu prihodi od gospodarske djelatnosti i stoga se u toj djelatnosti društvo SAŽP ne može smatrati poreznim obveznikom. Iz prethodno navedenog proizlazi da prihodi ne podliježu PDV-u i da nije moguće odbiti PDV na nastale troškove. U tim okolnostima SAŽP nije porezni obveznik PDV-a. (Croatian)

Η διάρκεια του έργου είναι 13 μήνες. Ο τόπος υλοποίησης του έργου είναι το έδαφος της Σλοβακικής Δημοκρατίας. Στο πλαίσιο του έργου, η δραστηριότητα εμπίπτει σε ειδικό cieľa:5.1.1 Εξασφάλιση της αποτελεσματικής εφαρμογής του προγράμματος (τομέας παρέμβασης 121). Το αποτέλεσμα του έργου θα είναι η ενίσχυση της ποιότητας των ανωτέρω δραστηριοτήτων και, ως εκ τούτου, η εξασφάλιση θετικού αντίκτυπου στην υλοποίηση του ΕΠ ΖΥΠ με στόχο την ελαχιστοποίηση των προβληματικών περιοχών που αντιμετωπίζει ο ΕΦ στο πλαίσιο της υλοποίησης του ΕΠ ΖΥΠ. Ο σλοβακικός Οργανισμός Περιβάλλοντος, ως οργανισμός του Υπουργείου Περιβάλλοντος της Σλοβακικής Δημοκρατίας, συνδέεται με τον προϋπολογισμό του Υπουργείου Περιβάλλοντος. Εκτός από τους πόρους αυτούς, λαμβάνει μη επιστρεπτέα χρηματοδότηση από επιχορηγήσεις και έργα που παρέχονται από κονδύλια της ΕΕ ή από τον εθνικό προϋπολογισμό. Τα εισοδήματα αυτά δεν αποτελούν εισοδήματα προερχόμενα από οικονομική δραστηριότητα και, ως εκ τούτου, στο πλαίσιο της δραστηριότητας αυτής, η SAŽP δεν μπορεί να χαρακτηριστεί ως υποκείμενος στον φόρο. Από τα προεκτεθέντα προκύπτει ότι τα έσοδα δεν υπόκεινται σε ΦΠΑ και ότι δεν είναι δυνατή η έκπτωση του ΦΠΑ επί των πραγματοποιηθεισών δαπανών. Υπό τις συνθήκες αυτές, η SAŽP δεν υπόκειται στον ΦΠΑ. Hankkeessa toimi kuuluu erityiseen cieľa:5.1.1 ohjelman tehokkaan täytäntöönpanon varmistamiseksi (interventioalue 121). Hankkeen tuloksena parannetaan edellä mainittujen toimien laatua ja varmistetaan näin myönteinen vaikutus toimenpideohjelman sivutuoteohjelman täytäntöönpanoon, jotta välittävän elimen kohtaamat ongelma-alueet voidaan minimoida toimenpideohjelmien sivutuoteohjelman täytäntöönpanon yhteydessä. Slovakian ympäristövirasto on Slovakian tasavallan ympäristöministeriön rahoittajaorganisaatio, ja se on sidottu ympäristöministeriön talousarvioon. Näiden varojen lisäksi se saa rahoitusta, jota ei makseta takaisin EU:n varoista tai kansallisesta talousarviosta myönnetyistä avustuksista ja hankkeista. Nämä tulot eivät ole taloudellisen toiminnan tuottamia tuloja, joten SAŽP:tä ei voida pitää verovelvollisena. Edellä esitetystä seuraa, että näistä tuloista ei kanneta arvonlisäveroa ja että aiheutuneita kustannuksia koskevaa arvonlisäveroa ei voida vähentää. Näin ollen SAŽP ei ole arvonlisäverovelvollinen. Rezultatem projektu będzie poprawa jakości powyższych działań, a tym samym zapewnienie pozytywnego wpływu na realizację PO ABP w celu zminimalizowania obszarów problemowych napotkanych przez IP w ramach realizacji PO PUPZ. Słowacka Agencja Środowiska, jako organizacja uczestnicząca w Ministerstwie Środowiska Republiki Słowackiej, jest powiązana z budżetem Ministerstwa Środowiska. Oprócz tych zasobów otrzymuje bezzwrotne finansowanie z dotacji i projektów dostarczanych z funduszy UE lub z budżetu krajowego. Dochód ten nie jest dochodem generowanym przez działalność gospodarczą i w związku z tym w ramach tej działalności SAŽP nie może być określany jako podatnik. Z powyższego wynika, że dochody nie podlegają opodatkowaniu podatkiem VAT i że nie jest możliwe odliczenie podatku VAT od poniesionych kosztów. W tych okolicznościach SAŽP nie jest podatnikiem VAT. A projekt eredménye a fenti tevékenységek minőségének javítása és ezáltal az OP ABP végrehajtására gyakorolt pozitív hatás biztosítása lesz azzal a céllal, hogy minimalizálják a KSZ által az OP ABP végrehajtásának keretében tapasztalt problémás területeket. A Szlovák Környezetvédelmi Ügynökség mint a Szlovák Köztársaság Környezetvédelmi Minisztériumának hozzájáruló szervezete a Környezetvédelmi Minisztérium költségvetéséhez kapcsolódik. E források mellett az uniós alapokból vagy a nemzeti költségvetésből nyújtott támogatásokból és projektekből vissza nem térítendő támogatást is kap. E jövedelem nem gazdasági tevékenységből származó jövedelem, így e tevékenység keretében a SAŽP nem tekinthető adóalanynak. V rámci projektu spadá činnost pod zvláštní cieľa:5.1.1 Zajištění účinného provádění programu (oblast intervence 121). Výsledkem projektu bude zvýšení kvality výše uvedených činností a tím zajištění pozitivního dopadu na realizaci OP ŽVP s cílem minimalizovat problémové oblasti, s nimiž se ZS setká v rámci realizace OP ŽVP. Slovenská agentura pro životní prostředí jako příspěvková organizace Ministerstva životního prostředí Slovenské republiky je vázána na rozpočet Ministerstva životního prostředí. Kromě těchto zdrojů získává nevratné finanční prostředky z grantů a projektů poskytnutých z fondů EU nebo z vnitrostátního rozpočtu. Tento příjem není příjmem pocházejícím z hospodářské činnosti, a proto v rámci této činnosti nelze SAŽP považovat za osobu povinnou k dani. Z výše uvedeného vyplývá, že příjmy nepodléhají DPH a že nelze odpočíst DPH z vynaložených nákladů. Za těchto podmínek není SAŽP osobou povinnou k DPH. (Czech)

Projekta rezultātā tiks stiprināta iepriekš minēto darbību kvalitāte un tādējādi nodrošināta pozitīva ietekme uz DP DzBP īstenošanu, lai līdz minimumam samazinātu problēmas, ar kurām IP saskaras saistībā ar DP DzBP īstenošanu. Slovākijas Vides aģentūra kā Slovākijas Republikas Vides ministrijas finansētāja organizācija ir saistīta ar Vides ministrijas budžetu. Papildus šiem resursiem tā saņem neatmaksājamu finansējumu no dotācijām un projektiem, ko nodrošina ES fondi vai no valsts budžeta. V okviru projekta dejavnost spada v posebno področje cieľa:5.1.1 Zagotavljanje učinkovitega izvajanja programa (intervencijsko področje 121). Rezultat projekta bo okrepiti kakovost zgoraj navedenih dejavnosti in tako zagotoviti pozitiven učinek na izvajanje OP ŽSP, da se čim bolj zmanjšajo problematična področja, s katerimi se PT srečuje v okviru izvajanja OP ŽSP. Slovaška agencija za okolje je kot donatorska organizacija Ministrstva za okolje Slovaške republike povezana s proračunom ministrstva za okolje. Poleg teh virov prejema nepovratna sredstva iz nepovratnih sredstev in projektov, ki jih zagotavljajo sredstva EU ali nacionalni proračun. Ti dohodki niso dohodki, ustvarjeni z gospodarsko dejavnostjo, zato se družba SAŽP v okviru te dejavnosti ne more šteti za davčnega zavezanca. Iz navedenega izhaja, da prihodki niso predmet DDV in da ni mogoče odbiti DDV na nastale stroške. V teh okoliščinah SAŽP ni davčni zavezanec za DDV. (Slovenian)

Резултатът от проекта ще бъде да се повиши качеството на горепосочените дейности и по този начин да се осигури положително въздействие върху изпълнението на ОП СЖП с цел свеждане до минимум на проблемните области, с които се сблъсква МЗ в рамките на изпълнението на ОП СЖП. Словашката агенция за околната среда, в качеството си на финансираща организация на Министерството на околната среда на Словашката република, е свързана с бюджета на Министерството на околната среда. В допълнение към тези ресурси тя получава безвъзмездно финансиране от безвъзмездни средства и проекти, предоставени от фондове на ЕС или от националния бюджет. Тези доходи не са доходи, генерирани от икономическа дейност, поради което в рамките на тази дейност SAŽP не може да се квалифицира като данъчнозадължено лице. От гореизложеното следва, че приходите не подлежат на облагане с ДДС и че не е възможно да се приспадне ДДС върху направените разходи. При тези обстоятелства SAŽP не е данъчнозадължено лице по ДДС. O resultado do projeto consistirá em reforçar a qualidade das atividades acima referidas e, assim, assegurar um impacto positivo na execução do PO SPA, com o objetivo de minimizar as áreas problemáticas com que o OI se depara no âmbito da execução do PO SPA. A Agência Eslovaca do Ambiente, enquanto organização contributiva do Ministério do Ambiente da República Eslovaca, está ligada ao orçamento do Ministério do Ambiente. Resultatet af projektet vil være at styrke kvaliteten af ovennævnte aktiviteter og dermed sikre en positiv indvirkning på gennemførelsen af OP'ets ABP med henblik på at minimere de problemområder, som det bemyndigede organ støder på i forbindelse med gennemførelsen af OP'ets ABP. Det slovakiske miljøagentur er som en bidragsyderorganisation under Den Slovakiske Republiks miljøministerium knyttet til miljøministeriets budget. Ud over disse midler modtager den ikketilbagebetalingspligtig finansiering fra tilskud og projekter fra EU-midler eller fra det nationale budget. Disse indtægter er ikke indtægter, der er genereret af en økonomisk virksomhed, og SAŽP kan derfor ikke i forbindelse med denne virksomhed betegnes som en skattepligtig person. Det følger af det ovenstående, at indtægterne ikke er momspligtige, og at det ikke er muligt at fradrage moms af de afholdte udgifter. Under disse omstændigheder er SAŽP ikke momspligtig. (Danish)

Proiectul „Servicii juridice pentru sprijinirea punerii în aplicare a IB SAŽP în cadrul PO KŽP” vizează finanțarea furnizării de servicii juridice pe baza cerințelor Agenției slovace de mediu (SAŽP) ca organism intermediar pentru Programul Operațional Mediu și Programul Operațional Calitatea Mediului pe baza Contractului de furnizare de servicii juridice nr. SAŽP SFEU/2018/16 încheiat cu contractantul Soukeník – ŠTRPKA, s.r.o. (http://www.crz.gov.sk/index.php?ID=3317208&l=sk) în următoarele domenii: a) representation of SAŽP before courts and public authorities;b) representation in proceedings before the competent court of the Slovak Republic in matters of review of the legality of decisions and procedures of SAŽP and/or on the basis of actions or remedies under the Administrative Judicial Code, including appeal procedures;c) representation in proceedings before the competent court of the Slovak Republic in matters of damages, compensation of wills, or provision of performance having a legal basis in the contract for the provision of non-repayable financial contribution, in proceedings of the IB on the termination of the contract on the provision of non-repayable financial contribution, including proceedings on remedies;d) representation and legal support in proceedings before the competent court of the Slovak Republic in connection with/or triggered by Act No 7/2005 Coll. on bankruptcy and restructuring and amending certain acts as amended in relation to the exercise of the rights of the Management Authority;e) legal services and representation in matters of criminal, administrative, commercial, civil labour law in connection with the implementation of EU programmes and/or in connection with the provision of co-financing of projects from the state budget of the Slovak Republic;f) taking over the representation of the client vis-à-vis other state bodies, natural persons or legal persons in the event of a dispute arising from the implementation of projects financed by EU funds and/or the ŠR;g) elaboration of legal analyses, opinions, recommendations, analyses of the various procedures of SAŽP, comments in legal matters, including the assessment of relevant documents, (h) drafting of opinions and legal analyses on disputed issues in the management of movable and immovable property in the framework of the implementation of projects financed by EU funds and/or from the state budget of the Slovak Republic;(i) legal analyses and other legal services in connection with Slovak and EU legislation;(j) legal services in the field of application of the Public Procurement Act No 343/2015, as amended and EU directives in the field of public procurement, application of Act No. 25/2006 Coll. on Public Procurement on Amendments and Supplements to Certain Acts, including consultations directly with the client, participation in negotiations with third parties and legal services in matters of control or supervision carried out by public authorities in the field of public procurement;k) preparation of draft legislative amendments according to the requirements of SAŽP, participation in negotiations and working meetings on these proposals and provision of related legal advice to the client,l) elaboration of expert opinions on legal issues related to public procurement processes and procedures within the meaning of applicable generally binding legal regulations governing public procurement;m) elaboration of legal analyses, opinions, recommendations, analyses for the assessment of existing business contracts SAŽP. Durata proiectului este de 13 luni. Locul de punere în aplicare a proiectului este teritoriul Republicii Slovace. În cadrul proiectului, activitatea intră sub incidența unui anumit cieľa:5.1.1 Asigurarea punerii în aplicare eficace a programului (zona de intervenție 121). Rezultatul proiectului va fi de a consolida calitatea activităților menționate mai sus și, astfel, de a asigura un impact pozitiv asupra punerii în aplicare a PO AB, cu scopul de a reduce la minimum domeniile problematice întâlnite de OI în cadrul punerii în aplicare a PO AB. Agenția slovacă de mediu, în calitate de organizație contributivă a Ministerului Mediului din Republica Slovacă, este legată de bugetul Ministerului Mediului. În plus față de aceste resurse, aceasta primește finanțare nerambursabilă din granturi și proiecte furnizate din fonduri UE sau de la bugetul național. Aceste venituri nu sunt venituri generate de o activitate economică și, prin urmare, în cadrul acestei activități, SAŽP nu poate fi considerată persoană impozabilă. Din cele de mai sus rezultă că veniturile nu sunt supuse TVA-ului și că nu este posibilă deducerea TVA-ului aferent cheltuielilor efectuate. Inom ramen för projektet omfattas verksamheten av en särskild cieľa:5.1.1 Se till att programmet genomförs effektivt (interventionsområde 121). Resultatet av projektet kommer att bli att höja kvaliteten på ovannämnda verksamheter och därmed säkerställa en positiv inverkan på genomförandet av OP ABP i syfte att minimera de problemområden som det förmedlande organet stöter på inom ramen för genomförandet av det operativa programmet för verksamhetsbaserad förvaltning. Den slovakiska miljöbyrån, som är en bidragande organisation för Slovakiens miljöministerium, är kopplad till miljöministeriets budget. Utöver dessa resurser får den icke återbetalningspliktig finansiering från bidrag och projekt från EU-medel eller från den nationella budgeten. Denna inkomst är inte inkomst som genereras av en ekonomisk verksamhet och SAŽP kan därför inte i denna verksamhet betecknas som en beskattningsbar person. Av det ovan anförda följer att intäkterna inte är mervärdesskattepliktiga och att det inte är möjligt att dra av mervärdesskatt på de uppkomna kostnaderna.
