    EL PROYECTO ¿DEMOCRACIA Y SOLIDARIDAD EN LAS INTEGRACIONES ECONOMICAS¿ PARTE DE LA HIPOTESIS, COMPROBADA EN EL ANTERIOR PROYECTO DE INVESTIGACION, DE QUE LA GLOBALIZACION, EN SUS DOS FASES, HA ORIGINADO UN EMBATE SOBRE EL CONCEPTO RACIONAL NORMATIVO DE CONSTITUCION. ADEMAS DE LAS SOLUCIONES YA PROPUESTAS, PODRIAN IMPLEMENTARSE OTRAS TRAS EL ESTUDIO DE DOS AMBITOS MATERIALES QUE HAN SURGIDO DE LAS CONCLUSIONES Y REFLEXIONES DEL ANTERIOR PROYECTO: EL GOBIERNO INTERNO DE LA GLOBALIZACION Y EL PRINCIPIO DE SOLIDARIDAD._x000D_ _x000D_ EL PROYECTO ESTIMA PERTINENTE CONTRIBUIR CON NUEVAS SOLUCIONES A TRAVES DE UN ENTENDIMIENTO CONSTITUCIONALMENTE ADECUADO DE LA POSICION DE LOS PODERES LEGISLATIVO, EJECUTIVO Y JUDICIAL EN EL INTERIOR DE LOS ESTADOS QUE SE INTEGRAN Y EN LA GOBERNANZA DE LA PROPIA INTEGRACION, TANTO EN SU GOBIERNO INTERIOR COMO EN EXTERIOR. ESTE ULTIMO SE REFIERE A SUS ACUERDOS CON OTROS ESTADOS E INTEGRACIONES, ASI COMO A LA HORA DE FIJAR POSICIONES Y RELACIONES CON LOS ORGANOS SUPRAESTATALES DE GOBIERNO DE LA GLOBALIZACION. SE ESPERA CORREGIR, EN PARTE, EL INEVITABLE DESPLAZAMIENTO DE COMPETENCIAS DEL LEGISLATIVO AL EJECUTIVO. IGUALMENTE, SE PRETENDE DETERMINAR LA POSICION Y COMPETENCIAS EN LA MATERIA DE LOS TRIBUNALES CONSTITUCIONALES (SUPREMO, EN SU CASO) Y DE LA JURISDICCION ORDINARIA, CON ESPECIAL ATENCION A SU RELACION CON LOS NUEVOS MECANISMOS DE ARBITRAJE QUE LA GLOBALIZACION ESTA INTRODUCIENDO. FINALMENTE, SE ESTIMA QUE PODRIAN APORTARSE SOLUCIONES CONTRIBUYENDO, MODESTAMENTE, A LA CONSTRUCCION DE UNA TEORIA GENERAL DEL PRINCIPIO DE SOLIDARIDAD EN EL INTERIOR DE LAS INTEGRACIONES Y DE SUS PRINCIPALES INSTRUMENTOS._x000D_ _x000D_ PARA CONSEGUIR ESTOS RESULTADOS SE TRATARIA DE DETERMINAR, COMO PRIMER OBJETIVO GENERAL, LA POSICION CONSTITUCIONALMENTE ADECUADA DEL PODER POLITICO Y JURISDICCIONAL DE CADA ESTADO EN LA FIRMA DE UN ACUERDO DE LIBRE COMERCIO Y EN LA GOBERNANZA DE LA INTEGRACION RESULTANTE (LO QUE VARIARA EN FUNCION DEL TIPO DE INTEGRACION: ACUERDO DE LIBRE COMERCIO, UNION ADUANERA, MERCADO COMUN, UNIDAD ECONOMICA SUPRAESTATAL Y/O MONETARIA)._x000D_ _x000D_ EL SEGUNDO OBJETIVO GENERAL INDAGARIA SOBRE LA POSICION CONSTITUCIONALMENTE ADECUADA DE LOS PODERES DE UNA INTEGRACION (UN ACUERDO DE LIBRE COMERCIO SOLO TIENE PODER EJECUTIVO; EN CAMBIO, UNA UNION ADUANERA EN CAMINO A MERCADO COMUN CREA LOS TRES PODERES) CUANDO EN LA SEGUNDA FASE DE LA GLOBALIZACION SE FIRMA UN ACUERDO DE LIBRE COMERCIO CON OTRA INTEGRACION O CON UN ESTADO Y SI CABE Y EN QUE MEDIDA UNA ACTUACION DE LOS PODERES CLASICOS DE LOS ESTADOS QUE FORMAN PARTE DE LA INTEGRACION._x000D_ _x000D_ EL TERCER OBJETIVO GENERAL CONSISTE EN ANALIZAR LA INTERVENCION DEL EJECUTIVO Y DEL LEGISLATIVO A LA HORA DE FIJAR LA POSICION DE UN ESTADO ANTE LOS ORGANOS DE GOBIERNO EXTERNOS O SUPRAESTATALES DE LA GLOBALIZACION (ESTO ES, SU POSICION ANTE LA OMC, G-20 Y G-7, OCDE, ETC.). CUANDO LOS ESTADOS DE UNA INTEGRACION HAYAN CEDIDO SUS COMPETENCIAS EN LA MATERIA A LA MISMA Y TENGAN ORGANOS EJECUTIVOS, LEGISLATIVOS Y JUDICIALES HABRA QUE ANALIZAR SU POSICION E INTERVENCION A LA HORA DE MANIFESTAR SU VOLUNTAD ANTE LAS INSTITUCIONES DE GOBIERNO EXTERNO DE LA GLOBALIZACION._x000D_ _x000D_ FINALMENTE, LA INTENSIDAD DE LA INTEGRACION GENERA UNA ESTRUCTURA CONSTITUCIONAL QUE OBLIGA A CONSIDERAR LOS PRINCIPIOS QUE PRESIDEN LOS ESTADOS COMPUESTOS Y ESPECIALMENTE EL DE SOLIDARIDAD Y COMO ESTE DEBE INCREMENTARSE A MEDIDA QUE SE PROFUNDIZA EN LA INTEGRACION, DESDE EL ACUERDO DE LIBRE COMERCIO A LA UNIDAD ECONOMICA Y MONETARIA SUPRAESTATAL (Spanish)

    THE PROJECT "DEMOCRACY AND SOLIDARITY IN THE ECONOMIC INTEGRATION" IS BASED ON THE HYPOTHESIS, PROVEN IN THE PREVIOUS RESEARCH PROJECT, THAT GLOBALIZATION, IN ITS TWO PHASES, HAS RESULTED IN A DRUBBING ON THE RATIONAL NORMATIVE CONCEPT OF CONSTITUTION. IN ADDITION TO THE SOLUTIONS ALREADY PROPOSED, OTHERS COULD BE IMPLEMENTED AFTER THE STUDY OF TWO MATERIALS AREAS THAT HAVE EMERGED FROM THE CONCLUSIONS AND THE REFLECTIONS OF THE PREVIOUS PROJECT: THE INTERNAL GOVERNANCE OF GLOBALIZATION AND THE PRINCIPLE OF SOLIDARITY. _x000D_ _x000D_ THE PROJECT CONSIDERS RELEVANT TO CONTRIBUTE WITH NEW SOLUTIONS THROUGH A CONSTITUTIONALLY ADEQUATE UNDERSTANDING OF THE POSITION OF LEGISLATIVE, EXECUTIVE AND JUDICIAL POWERS INSIDE THE STATES THAT ARE INTEGRATED, AND IN THE GOVERNANCE OF THE OWN INTEGRATION, BOTH IN ITS INTERIOR GOVERNMENT AND IN ITS EXTERIOR GOVERNMENT. THE LAST ONE IS REFERED TO ITS RELATIONS WITH OTHER STATES AND INTEGRATIONS, AS WELL AS, TO THE TIME WHEN POSITIONS AND RELATIONSHIPS WITH THE SUPRANATIONAL BODIES OF GOVERNANCE OF GLOBALIZATION ARE FIXED. THE INEVITABLE DISPLACEMENT OF LEGISLATIVE POWERS TO THE EXECUTIVE IS EXPECTED TO BE CORRECTED, IN PART. EQUALLY, IT IS INTENDED TO DETERMINE THE POSITION AND COMPETENCES IN THE MATTER OF THE CONSTITUTIONAL COURTS (SUPREME COURT, IN ITS CASE) AND THE ORDINARY JURISDICTION, WITH SPECIAL ATTENTION TO ITS RELATIONSHIP WITH THE NEW MECHANISMS FOR ARBITRATION THAT GLOBALIZATION IS INTRODUCING. FINALLY, IT IS ESTIMATED THAT SOLUTIONS COULD BE PROVIDED CONTRIBUTING, MODESTLY, TO THE CONSTRUCTION OF A GENERAL THEORY OF THE PRINCIPLE OF SOLIDARITY INSIDE INTEGRATIONS AND THEIR MAIN INSTRUMENTS._x000D_ _x000D_ TO ACHIEVE THESE RESULTS, IT WOULD BE NECESSARY TO DETERMINE, AS FIRST GENERAL OBJECTIVE, THE ADEQUATE CONSTITUTIONAL POSITION OF THE POLITICAL AND JURISDICTIONAL POWER OF EACH STATE IN THE SIGNATURE OF A FREE TRADE AGREEMENT AND IN THE GOVERNANCE OF THE RESULTING INTEGRATION (WHICH WILL VARY DEPENDING ON THE TYPE OF INTEGRATION: FREE TRADE AGREEMENT, CUSTOMS UNION, COMMON MARKET, MONETARY AND/OR SUPRANATIONAL ECONOMIC UNION). _x000D_ _x000D_ THE SECOND GENERAL OBJECTIVE WOULD BE INVESTIGATE ABOUT THE ADEQUATE CONSTITUTIONAL POSITION OF THE POWERS OF AN INTEGRATION (A FREE TRADE AGREEMENT ONLY HAS EXECUTIVE POWER, WHILE A CUSTOMS UNION IN ITS WAY TO COMMON MARKET CREATES THE THREE POWERS) WHEN IN THE SECOND PHASE OF GLOBALIZATION ITS SIGNED A FREE TRADE AGREEMENT WITH OTHER INTEGRATION OR WITH A STATE, AND IF IT IS POSSIBLE AND IN WHICH EXTENSION THE CLASSIC POWERS OF THE STATES THAT FORM PART OF THE INTEGRATION CAN ACT. _x000D_ _x000D_ THE THIRD GENERAL OBJECTIVE CONSISTS IN ANALYSING THE INTERVENTION OF EXECUTIVE AND LEGISLATIVE POWERS WHEN THEY FIX THE POSITION OF A STATE WITH RESPECT TO THE EXTERNAL OR SUPRANATIONAL BODIES OF GOVERNANCE OF GLOBALIZATION (IN OTHER WORDS, ITS POSITION BEFORE THE WTO, G-20 AND G-7, OECD, ETC.). WHEN THE STATES OF AN INTEGRATION HAVE ASSIGNED THEIR COMPETENCES IN THE MATTER TO IT AND HAVE EXECUTIVE, LEGISLATIVE AND JUDICIAL BODIES, ITS POSITION AND ITS INTERVENTION AT THE TIME THEY EXPRESS THEIR WILL AT THE INSTITUTIONS OF EXTERNAL GOVERNMENT OF GLOBALIZATION WILL HAVE TO BE ANALYSED._x000D_ _x000D_ FINALLY, THE DEEPENING OF THE INTEGRATION GENERATES A CONSTITUTIONAL STRUCTURE THAT FORCES TO CONSIDER THE PRINCIPLES THAT PRESIDE OVER COMPOSITE STATES AND, SPECIALLY, THE PRINCIPLE OF SOLIDARITY AND HOW THIS ONE MUST BE INCREASED WHEN THE INTEGRATION IS DEEPER, SINCE THE FREE TRADE AGREEMENT TO THE SUPRANATIONAL ECON (English)
