The idea of the project stems from the fact that a large number of changes are being made in the ways in which various criminal disputes are resolved within the EU. The increasing workload in traditional courts, increasing litigation costs, delays, willingness for confidentiality and the willingness of the parties to have greater control over the choice of the person or persons who will resolve their dispute have contributed to the fact that many parties have begun to consider alternative methods of dispute resolution (ADR). All these processes question how the European scene of dispute resolution is changing and whether changes are desirable. They also raise the question whether the fundamental Article 6 of the ECHR (citizens’ right to a fair trial) is respected in such cases. Our project idea aims to study ADR practices in particular — Arbitration in Bulgaria and good world practices. Achieving the strategic objective of the project requires creating conditions for quality arbitration. Also knowledge of the advantages of arbitration by stakeholders. Taking this into account, the project foresees logically related and complementary activities to increase the quality of arbitration and promote it among the target groups. The activity of research and analysis of the case law in cases of annulment, enforcement and nullity of arbitral awards is separate. An analysis of good practices for international arbitration with recognised global models is envisaged. The aim is to identify and overcome frequent arbitrage gaps and to create conditions for the adoption of good global practices. The analyses will be organised in electronic editions and presented at a round table conference, where they will be discussed with the target groups. An information campaign will be conducted to promote the arbitration, in the form of information events. The project will be implemented for 15 months by the beneficiary and the partner. (English)

    Идеята за проекта произтича от факта, че се извършват голям брой промени в начините, по които се решават различни спорове инаказателни дела в рамките на ЕС. Увеличаващата се натовареност в традиционните съдилища, нарастващите разходи за съдебни спорове, забавянията, желанието за конфиденциалност и желанието на страните да имат по-голям контрол върху избора на лицето или лицата, които ще решат спора помежду им, са допринесли за факта, че много страни са започнали да разглеждат алтернативни методи за разрешаване на спорове (АРС). Всички тези процеси поставят под въпрос как се променя европейската сцена наразрешаването на спорове, както и дали промените са желателни. Освен това, те повдигат въпроса дали основният член 6 от ЕКПЧ (право на гражданите на справедлив процес) се спазва в подобни случаи. Нашата проектна идея има за цел да изследва практиките за АРС в частност - Арбитража в България и добрите световни практики. Постигането на стратегическата цел на проекта изисква създаване на условия за качествен арбитраж. Също така познаване на предимствата на арбитража от заинтересованите страни. Отчитайки това, проектът предвижда логически свързани и допълващи се дейности за повишаване качеството на арбитража и популяризирането му сред целевите групи. Обособена е дейност проучване и анализ на съдебната практика по дела за отмяна, изпълнение и обявяване на нищожност на арбитражни решения. Предвижда се анализ на добрите практики за международния арбитраж с признати световни модели. Целта е да бъдат установени и преодолени често срещани пропуски при арбитража и да бъдат създадени условия за възприемане на добри световни практики. Анализите ще бъдат оформени в електронни издания и представени на конференция тип кръгла маса, където ще се дискутират с целевите групи. Ще бъде проведена информационна кампания за популяризиране на арбитража, под формата на информационни събития. Проектът ще се изпълнява за 15 месеца от бенефициента и партньора. (Bulgarian)
