The essential reason for the project is the need for the Member States of the European Union to implement Directive 2006/123/EC of the European Parliament and of the Council of 12 December 2006 on services in the internal market as regards the creation and operation of a contact point as described in Article 6, 7, 8 and 21 of that Directive.Directive 2006/123/EC was transposed into Polish law by the Act of 4 March 2010 on the provision of services in Poland.That law also amended the Law on freedom of economic activity, in which Chapter 2a, the provisions of which directly govern the establishment and operation of the electronic contact point.The mandatory scope relates to the following three functions: the Single Point of Contact:• Information function — to allow access to the directory of information set out in Article 22b of the Freedom of Business Activity Act.• Operational work — to provide the possibility to complete the necessary procedures and formalities in connection with taking, executing, suspending and completing business in a remote and electronic manner.• Support and assistance function — to enable users of the electronic contact point to submit requests for information to the extent compatible with the purposes of the operation of the Electronic Contact Point and to respond to them.The extension action (with the necessary organisational and legal equipment) of the service structures — the Single Point of Single Contact — is part of the existing strategic directions of the Ministry of Economy and forms part of the continuation of the coordinated efforts of the Polish Government to create a real support environment for Polish companies.This applies in particular to aid to the micro, small and medium-sized enterprises (SMEs) in the use of modern ICT.     Zasadniczym powodem realizacji Projektu jest konieczność implementacji przez Państwa Członkowskie Unii Europejskiej Dyrektywy 2006/123/WE Parlamentu Europejskiego i Rady z dnia 12 grudnia 2006 r. dotyczącej usług na rynku wewnętrznym w zakresie utworzenia i zapewnienia funkcjonowania punktu kontaktowego, który został opisany w art. 6, 7, 8 i 21 wspomnianej Dyrektywy. Do polskiego porządku prawnego dyrektywa 2006/123/WE została zaimplementowana przez ustawę z dnia 4 marca 2010 r. o świadczeniu usług na terytorium Rzeczpospolitej Polskiej. Ustawa ta znowelizowała także ustawę o swobodzie działalności gospodarczej, w której znalazł się rozdział 2a, którego przepisy bezpośrednio regulują utworzenie i funkcjonowanie Elektronicznego Punktu Kontaktowego. Obowiązkowy zakres dotyczy trzech następujących funkcji Pojedynczego Punktu Kontaktowego: • Funkcja informacyjna - polega na umożliwieniu dostępu do katalogu informacji, określonego w art. 22b ustawy o swobodzie działalności gospodarczej. • Funkcja operacyjna - polega na udostępnieniu możliwości dopełnienia niezbędnych procedur i formalności związanych z podejmowaniem, wykonywaniem, zawieszeniem i zakończeniem działalności gospodarczej w sposób zdalny i elektroniczny. • Funkcja wsparcia i pomocy - polega na umożliwieniu użytkownikom Elektronicznego Punktu Kontaktowego składania wniosków o udzielenie informacji w zakresie zgodnym z celami funkcjonowania Elektronicznego Punktu Kontaktowego i uzyskanie na nie odpowiedzi. Działanie polegające na rozbudowie (wraz z niezbędnym wyposażeniem organizacyjno-prawnym i narzędziowym) struktur usługowych Pojedynczego Punktu Kontaktowego, wpisuje się w dotychczasowe kierunki strategiczne Ministerstwa Gospodarki oraz jest elementem kontynuacji skoordynowanych działań Rządu RP, zmierzających do stworzenia realnego środowiska wsparcia polskich przedsiębiorstw. Dotyczy to zwłaszcza pomocy dla sektora mikro, małych i średnich firm (MSP) w korzystaniu z nowoczesnych technologii ICT. (Polish)
