THE GENERAL PUBLIC HEALTH LAW (LAW 33/2011, OF 4 OCTOBER) AIMS TO BE A TURNING POINT WITH THE DESIRE TO MAKE VISIBLE AND VERTEBRATE THE CONTENTS OF A BRANCH OF HEALTH LAW DESATENTIDA, ESPECIALLY IN THE KEY OF LEGAL RESEARCH. THIS LAW JOINS A MOVEMENT THAT HAS ALSO CRYSTALLISED ON AN AUTONOMIC SCALE IN AN IMPORTANT SET OF PUBLIC HEALTH LAWS THAT ESSENTIALLY AIMS TO DEMONSTRATE THE NEW PUBLIC HEALTH INTELLIGENCE AND THE SERIOUS SHORTCOMINGS AND MISMATCHES THAT THE CURRENT REGULATORY FRAMEWORK OFFERS TO FACE PROBLEMS AND RISKS THAT, FAR FROM WHAT CAN BE ASSUMED, ARE PART OF THE USUAL AGENDA OF THE HEALTH ADMINISTRATION. IN ADDITION TO THE FIRM ALDABONAZOS IN THE FORM OF SOUND EPISODES THAT ALERT US ALL (SEVERE ACUTE RESPITARY SYNDROME, FLU “A”, EBOLA), THE TRUTH IS THAT SUCH COMMON MEASURES AS VACCINATION CONSTITUTE TECHNIQUES OF PUBLIC HEALTH OF A MAJOR IMPORTANCE BUT WHOSE NORMATIVE FRAMEWORK, HOWEVER, DOES NOT MANAGE TO CLEAR ALL THE PROBLEMS THAT ARISE AROUND. THE SAME COULD BE SAID OF MANY OTHER MEASURES SUCH AS HOSPITALISATIONS, HOSPITALISATIONS, QUARANTINES, ACCESS TO CLINICAL HISTORIES... EVEN THE COURTS DO NOT HAVE A CLEAR PROCEDURAL GUIDE IN THIS REGARD. _x000D_ in this renewal of public health is NOT ONLY PERCEPTIBLE THE PREOCUPACATION BY A CABAL ADJUSTE OF TRADITIONAL MEASURES OF INTERVENTION IN HAS SANITARY RIESGY WHICH THE AGREEMENT IN THE NEW CONCEPTION OF THE PUBLIC HEALTH THAT IS EVERYTHING IN THE INTERNATIONAL PLANATION AND THAT IS EXPONENT FIRST WHO. THERE IS, IN FACT, A POSITIVE DIMENSION OF PUBLIC HEALTH THAT APPEALS TO THE DETERMINANTS OF HEALTH AND TO THE NEED FOR PUBLIC POWERS TO INTERNALISE THAT IN THE MISSION OF GUARANTEEING THE HIGHEST ATTAINABLE STANDARD OF HEALTH, THE CONDITIONS (SOCIAL, ECONOMIC, LABOR, ENVIRONMENTAL) IN WHICH THE LIVES OF PEOPLE DEVELOP ARE BECOMING MORE AND MORE PROMINENT. AMONG THESE DETERMINANTS OF HEALTH THERE ARE MANY FACTORS TO BE TAKEN INTO ACCOUNT; AS IT IS, OF COURSE, ITS DIFFERENT INTENSITY AND CONNECTION WITH PEOPLE’S HEALTH. HOWEVER, SOME OF THESE DETERMINANTS SEEK TO MAKE THEIR WAY TO CONSOLIDATE THEMSELVES AS AUTHENTIC PUBLIC HEALTH RIGHTS AND, AMONG THEM (ACCESS TO WATER, VACCINATION), ACCESS TO FOOD STANDS IN ONE OF THE MOST OUTSTANDING. A THAT ORIENTATION, RASTREABLE WITH CLARITY IN OUR STATES OF OUR ENVIRONMENT, IS NOT TODAVIA IN SPAIN._x000D_ THE PROJECT THAT IS PRESENT TO OFREC A SIGNIPHICATIVE ADVANCE IN THE INVESTIGATION OF THE NORMATIVAL FRAMEWORK OF THE PUBLIC HEALTH AND THIS INTELIGENCE FROM THE BASIC STATE OF REFERENCE THE FUNDMENTAL RIGHTS SYSTEM; THIS IS WITH THE CONVICTION THAT ONLY FROM A SOLID, SERENE AND DEEP ANCHORAGE OF PUBLIC HEALTH WITH THE SYSTEM OF BASIC RIGHTS AND FREEDOMS, AND AS A LIMIT THAT AS A MATRIX OF BENEFITS RIGHTS, IT WILL BE POSSIBLE FOR THIS PARCEL OF HEALTH LAW TO ACQUIRE THE IMPORTANCE IT REALLY DESERVES.
